The Supreme Court Trawl on Global Warming
Time to take a deep breath of polluted greenhouse gas-y air and look at some of the best comments offered about yesterday's monumental Supreme Court ruling on global warming and the Bush administration's (shall we say) so-far tepid response to it. From the ruling itself, I give you first the irrepressible Antonin Scalia, the Justice who started his dissent with this question: "Does anything require the [Environmental Protection Agency] Administrator to make a 'judgment' whenever a petition for rulemaking is filed? Without citation of the statute or any other authority, the Court says yes. Why is that so?" In other words, Justice Scalia asked, why should the EPA be forced to do anything to address an environmental problem?
Chief Justice John G. Roberts, Jr. wrote this in his dissent: "The very concept of global warming seems inconsistent with this particularization requirement [to have standing to sue]. Global warming is a phenomenon 'harmful to humanity at large,' (citation omitted), and the redress petitioners seek is focused no more on them than on the public generally--it is literally to change the atmosphere around the world." In other words, the Chief Justice wrote, the injuries that could be caused by global warming are so immense, and the means to redress those injuries could be so wide-spread, that any single plaintiff, or group of plaintiffs, can't satisfy the gateway test of standing. And this, from Justice John Paul Stevens, who wrote the Court's majority: "EPA has refused to comply with this clear statutory command. Instead, it has offered a laundry list of reasons not to regulate." In other words, Stevens wrote, the EPA has to do something about global warming or explain in a compelling way why it won't.
Linda Greenhouse, the doyenne of Supreme Court reporters, wrote this as her lead in the New York Times: "In one of its most important environmental decisions in years, the Supreme Court ruled on Monday that the Environmental Protection Agency has the authority to regulate heat-trapping gases in automobile emissions. The court further ruled that the agency could not sidestep its authority to regulate the greenhouse gases that contribute to global climate change unless it could provide a scientific basis for its refusal.
"The 5-to-4 decision was a strong rebuke to the Bush administration, which has maintained that it does not have the right to regulate carbon dioxide and other heat-trapping gases under the Clean Air Act, and that even if it did, it would not use the authority. The ruling does not force the environmental agency to regulate auto emissions, but it would almost certainly face further legal action if it failed to do so. "
David Savage, the Supreme Court reporter for the Los Angeles Times, offered this: "The Supreme Court cleared the way Monday for a more aggressive attack by government on global warming, which could include the first national rules to limit carbon dioxide emissions from new cars, trucks and power plants. In a 5-4 decision, the high court rebuked the Bush administration and ruled that so-called greenhouse gases -- like carbon dioxide -- were air pollutants subject to federal regulation. President Bush and his aides, allied with automakers, argued that federal officials did not have the power to set mandatory limits on greenhouse gas emissions. The court's ruling knocked down a legal barrier that kept California and other states from requiring reduced carbon emissions by new vehicles starting in 2009."
USA Today's Joan Biskupic had this: "A Supreme Court ruling Monday that the Environmental Protection Agency can regulate carbon dioxide and other greenhouse gases galvanized groups that have long sought to limit emissions from new cars and trucks. The 5-4 decision in the court's first-ever case on global warming forces the EPA to re-evaluate whether its regulation of tailpipe emissions should include carbon dioxide. It also adds momentum to congressional and state efforts to address climate change. The opinion could ultimately affect whether automakers are required to build higher-mileage vehicles that emit less carbon dioxide. In rejecting Bush administration arguments, the court emphasized the link between increased concentrations of carbon dioxide in the atmosphere and rising temperatures."
The great Tony Mauro at the Legal Times had this: "The decision took an unusually broad view of standing -- usually a major obstacle in environmental lawsuits -- by finding that, even though warming is a diffuse global problem, Massachusetts has already been significantly injured. 'These rising seas have already begun to swallow Massachusetts' coastal land,' [Justice John Paul] Stevens wrote. Groups that sided with Massachusetts immediately applauded the decision as one of the most important environmental rulings in history. The finding that carbon dioxide -- one of the gases at issue -- is an air pollutant could also have implications for coal-fired power plants and other environmental issues."

Those smart justices may or may not know that burning petroleum products makes CO2 whether they ordain otherwise or not. True, it is far past time for citizens of the U.S.A. to stop buying gas hog SUVs and large pickup trucks to drive one or two people to a nearby big box store. This, not because of CO2 emissions, but because we are entirely too dependent on foreign oil sources.
It is turns out that human contribution to global warming is trivial (I'm of that mind) and in the meantime we wreck our economy over CO2 emissions, then our children and grandchildren will pay the price.

CH, You are one of the few who is of that mind. The overwhelming body of evidence points to our effects on global temperature, and the overwhelming number of climatologists belive that. And the few who dispute the findings have more often than not been found to be funded or backed by the petroleum industry or their "think tanks". The simple fact that the world population has grown in one generation (1946-2006) by a factor that previously took 10,000 GENERATIONS to acheive points to a very serious problem. Extrapolate that to the next generation and we are in a world of hurt. The problem is, for those of you who want to *put your hand in the wound* so to speak, before you believe, by the time you have your undeniable truth, it will most certainly be too late. There will be no ecomony to ruin.

Try watching the British Documentary on the Global Warming Farce. Humans assume to big a role here. The sun, in all its fury and sometimes lack thereof produces climate change, has for billions of years and will continue to do so even as the human race becomes extinct. There is less carbon dioxide in the air now that 2000 years ago. Samples from the ice age clearly articulate that CO2 emissions have little to do with climate change. The UN paper was not written by the scientists, in fact, many names on the list reject the UN report. It's summary was written by the politicians. Examine the other side of this debate for a little while. Find out the facts. One good volcano equals a whole lot of cars and smoke stacks. Have the EPA run out and regulate Volcanos, now there is a task that we all can sign up to.

Regarding that British documentary, some background:
The basic claim is simple - climate change is not being driven by anthropogenic CO2 emissions. The evidence isn't there or the evidence that is there contradicts the hypothesis. Climate change is occurring but it is natural and driven by solar and cloud activity. Global warming is a swindle engineered by climate scientists seeking to sell science by creating extreme stories and who benefit from larger research budgets. Its all a 'lie' and a 'conspiracy'.
The film thus attacks the global warming orthodoxy. The arguments are familiar - the film apparently took 10 years to make so, in fact, many of the arguments have been addressed and thoroughly refuted. The film ignores all evidence and views supporting the global warming hypothesis and the extensive literature setting out these refutations.

There is No Consensus; Why Not Seek Facts Instead of Preaching??
There are myriad sources and thousands of scientists and other experts who will tell you -- man's contribution to global warming; and, the idea that warming is and will happen to an extent that will cause harm -- are far from foregone conclusions. Why act rashly in an extremely expensive manner based on this?? Why not take the time to analyze what's best for America and the world? Is hamstringing our economy really worth it? Could the money and resources be better spent.
What's so disturbing is that among the masses there is a RELIGIOUS FAITH in the creed of manmade destruction through global warming. Any dissent is treated as heresy. As a society, let's not replace outdated religious dogmas with an equally fact-less witch hunt. Most people in the Center to Left of this country are absolutely LOATHE to folks who seek to IMPOSE their religious beliefs on others. This is no different. Global warming is just a "Secular Sin" that replaces religious sin for people with that void in their lives. If YOU are worried about Global Warming and your impact on the planet's well being, then YOU SHOULD CHANGE YOUR WAYS FIRST, lead by example, see if it convinces others, and let people LIVE THEIR OWN LIVES HOW THEY CHOOSE.

I drive a Prius. And sorry, in this case, the way you live your life affects me. Driving your Escalade to the 7-11 around the corner for a gallon of milk affects me. And I expect our elected government to act to protect its people. How about basing the price of a gallon of gas on the MPG of the car being fueled? If gas guzzlers had to pay 5.00 to 3.00 for a Honda accord, I'll be you'd see a RAPID improvement in auto technology. As Bill Gates said *If GM had kept up with technology like the computer industry has, we would all be driving $25.00 cars that got 1,000 miles to the gallon.*. But the petro industry has its tentacles so deep into our government they do not have to change.

The good-cop-bad-cop ploy by the control freaks in government miss the point. The Supreme Court and the Bush administration only appear to be on different sides. This is illusion. The Supreme Court decision to justify more regulation by overinflated bureaucracy will cost taxpayers more than it will deliver in practical results.
The private automobile is a dying concept, but removing one form of transportation without providing another only exacerbates the problem. Those who can least afford these extra costs will be squeezed out of transportation.
Supporting good public transportation will also reduce global warming over the coming years, give people alternatives to the highly subsidized automotive industry, and reduce dependence on foreign oil.
A more significant contributer to global warming will be the heavily promoted ethanol industry, which represents a net-loss in energy. This is a much more sinister assault on the environment, but the yes-men and women in government and bureaucracy are so busy funding it, they don't want to see the hypocrisy.

Very good points. However, the absence of a good public transportation policy, alternate energy technologies (which will be fought by the petro industry) and the like necessitate our governments involvement via regulation. There will be no voluntary change by the global corporations unless they are forced. There will be no investment of the 10 billion in profit Exxon made in the 4th qtr into public transportation. Now if that profit were taxed at 50%, and the money provided to states to create/develop/improve public transportation systems, then we may see some progress. But don't count on the "good intentions" of business to help the situation.

Isnt it better to just help a cause even if it could be a problem then just sit on it?

I feel that we have just opened the door to more problems. I agree that the EPA should be setting the standard nationally; what else would the Environmental Protection agency do? Environment and Protection could be defined as protecting the environment and regulating all things that affect it. We need one clean air requirement. Allowing states to set their own standards will just add on to confusion and cause energy prices to increase as more layers are being added. Let's take the cleanest standard and go with it nationally. We need one clean air standard. Different requirements for each state will just add costs to the consumer in the end. If anyone thinks that the tax paying consumer will not pay for 50+ environmental standards that could potentially affect everything from distribution to manufacturing then they are dead wrong.

The nuclear power industry was shut down because it's economically inefficient for one thing. Without HEAVY government subsidies, there's no profit to be made with nukes. Govt subsidies require public support, and when weighed against the risks of a single accident, the public says no.

You may be entitled to your own opinion but you are not entitled to your own facts. The science of global warming is as settled as the Bohr atom so quit pretending there remains doubt to allow your stated view. There isn't any such doubt.
Proceeding to your second lie, the idea that responding to this threat will "wreck the economy." There is no evidence of this and there is substantial evidence to the contrary. In many ways our effect on the environment reflects inefficiency and reducing that effect means increasing our efficiency, and that usually falls under the category of "good things."

I so sick of you so-called "conservatives" spewing forth the mindless, anti-scientic garbage you hear on talk radio every day. GLOBAL WARMING IS NOT A RELIGION. BUT DOING SOMETHING ABOUT IS A RELIGIOUS IMPERATIVE! Apparently, you have never read the words of religious leaders like the Patriarch of Constantinople who make it clear that disrupting the order of our planet is a sin.
Of course, all scientists will never agree on everthing, but conservatives-of all people-should realize our policy should be built around what is true all or most of the time. And MOST sceintists are telling us global warming is real and man-made, not to mention the real world experiences of people like myself who live in northern areas and have seen winter disappear the past 20 years. But apparently you girly-man conservatives are too weak to actually go outside in the winter. If you did, the realities of global warming would be self-evident.

Scientists work by discussing and arguing points of theory and testing hypotheses. There are some scientists who debate the exact nature and reason for global warming. But the vast majority consensus of environmental scientists is that global warming is here, it is observable, it is fitting well with projections of models and it is caused almost exclusively by greenhouse gases emitted by our industries, our transportation and our farming practices. Believe me, getting a bunch of scientists to agree on something because of a "conspiracy" is absolutely counter to the way scientists work and think. They are by nature questioners and skeptics. To have the consensus we have now from environmental scientists should be good enough for us to take action to avoid destroying human life.

Most of the comments above miss the point. The case was not about the global warming agument, it was about the meaning of the act passed by Congress and signed into law. The majority held the law actually means what it says, that the EPA is required to carry out the provisions of the law. The minority held the EPA may ignore the law.

Two points.
1. To say the science is squishy is to fundamentally misrepresent the nature of experimental design and the theories which arise therefrom. To prove Global Warming is to assume the null hypothesis, Global Cooling or Global Same-old Same-old are true. When the data shows the null hypothesis to be false then there you have it! Or, as Sir Arthur Conan Doyle, (Sherlock Holmes) put it *...when you have eliminated the impossible, whatever remains, however improbable, must be the truth.*. The EPA is plumb out of impossibilities.
2. As far as the impending economic destruction of life as we know it: Lighten up. Regulations have never been required to "follow" the science. A drunk driving conviction does not hinge on wine or Wild Turkey and the considerable difference in alcohol content. For another example, the sentance you'll get for crack (Cocaine Free Base + Salt) or blow (Cocaine HCl) has no basis in Chemistry. Legislatures have to be obeyed, scientific or not.

Global Warming and some observations about searching out FACTS!
W.J.D., Tom, Midwesterner, et al, If you MUST rely on a 'British Documentary'[?] about the 'Great Global Warming Swindle video on 'youtube.com', I suggest that you scroll down the video titles a bit further and you will find that video being exposed as a fake 'expose'. If you want factual data from reputable scientists then use Google to search out textual scientific papers, presented at scientific meetings and presented for publication, then you will find facts about Global Warming and the looming world-wide disasters , the probable famine, drought, and inundations of low-lying lands currently occupied by humans; billions of humans. This is the "Doomsday" scenario facing us, all of us, unless we make our governments act to reduce CO2 pollution being pumped into our atmosphere 24x7. Global warming is no longer a debatable issue; the Oil Industry Oligarchy can no longer pay fraudulent 'scientists' to produce papers casting doubt on the real scientists or their finding - look that us in Google also.
Give some rational thought to what 'MIGHT' has caused the geometric increases in CO2 within the last 50 even 100 years. Consider the example used by the post above that ridicules the effects of automobile pollution. Stop and think for a moment sir, take a shot at the math and try calculating how many autos in America x people + avg cars per family, usage and fuel efficiency [[HINT efficiency is an inverse of pollution]given the number of gas guzzling SUVs. [HINT - LA was smog free until mid-20th century]
Once you get that UGLY factoid generalize that number to the rest of the industrialized world considering that American is in the last place for automobile fuel efficiency but offset that by the nations without any pollution control at all such as India, China, most of Africa, etc. Is it possible that the unburned hydrocarbons spewing out of every automobile tailpipe 'MIGHT' be a major factor in the equation?
I'm not preaching, nor am I Global Warming prophet parading around Times Square in robes and sandal with a sign saying the 'End is Near' but I believe that rational people everywhere across the world devote thought and then action to limit the manmade and discharged 'Greenhouse gases' that are the causative factors. I want my grandchildren and their children to live in a world similar, but cleaner than the one we live in right now and will continue my efforts to change my lifestyle and try to get others to do likewise. I don't have the time or patience to deal with dupes and fools that blindly accept the words of Oil Industry paid charlatans casting doubts or nay saying about Global Warming; factual scientific data is available on the Internet - factual data on scientists and their credentials is also there and if there are 1000 scientists presenting papers on evidence and 10 that are casting doubts on both the evidence and the scientists - Which are you going to believe? If you pick the 10 - WHY?

volcano, man-made co2, whatever. at the end of the day, nature is not a free trash dump. never has been, never will. we americans these days cry and moan too much, and use regulation and government as scapegoats. big 3 balk at eco-friendly cars, so the japanese go and make a business out of hybrids and gas-sipping cars, cementing their status as economic and manufacturing powerhouses.
this generation of Americans who so disdain science and favor controversy, name-calling etc., basically yapping about how we can't do this because of that, just consider that we are pretty worthless compared to generations of past that we're shouldering on. the people who won wwii, went to moon, treated science and art with the respect and support that it deserves, giving us the united states of america that we got today, and actually spent time to sit down and read a newspaper vs. yelling mouthpieces on tv.
we're relying on the hard work, science, and policies that our grandparents laid for us and have pretty much come to a standstill since. hawks should stop making excuses for why we can't do something constructive (vs. 100% rah-rah flag-waving support for the destructive) and begin to take responsbility for the crud we put out for nature to dispose as though it should be obligated to pick up after our cr*p w/o consequences. full of naivete and dogmatic bs. as the old saying goes, there ain't no free lunches, and it's about time we stop pretending otherwise.

Global warming, just like everything else in this country (e.g., war, healthcare, gay marriage) has become split, seemingly irrevocably, along partisan lines.
Why can't people take a short break from being liberals and conservatives, inhale a deep breath of fresh air (to use a pun), and think about what's best for this country and the future of its people?
Today, we fight along partisan lines because we don't have the guts or will to use good sense and logic. We refuse to admit failure in our leaders because it would mean admitting failure in ourselves (we elected them, right?).

We mistakenly think government should force Exxon et al. to pay for public transportation. However, taxpayers pay government over and over for the same services, but only get nominal caricatures, because government is funnelling taxpayer money into cushy government contracts for the megacorporations, including Exxon. That's why Exxon, et al. are able to generate such huge profits. Taxpayers need to force GOVERNMENT, not the private industries, to shift funding to public transportation. When you consider how much taxpayer money goes to subsidize the automotive industry, you will realize shifting funding sends a signal that government works for the people, and not the other way around.

Human causality of it is NOT.
The EPA has resisted getting involved in regulating CO2 emissions because carbon dioxide is not a pollutant. It is a vital component of our atmosphere. Just think where all life would be without the stuff!
Meanwhile, the debate does still rage on regarding true causality of climate change. It is still to be settled if the chicken or the egg came first. It is not nearly so easily discerned as horse-first or cart-first.

The balance of the evidence is that global warming is a) real and b) largely human caused. Based on that it seems sensible to make changes to reduce greenhouse gas emissions as quickly as possible. This may or may not have significant net economic costs, and if it does, that is the price we pay for avoiding the much greater costs of dramatic climate change.
But nothing in the future is absolutely certain. If I am wrong, our children and grandchildren will live in a world where the GDP is a couple of per cent lower than it could have been.
If climate change deniers are wrong and we do nothing, our children and grandchildren will live in a world that is immeasurably poorer, economically, socially and ethicly. (Why ethicly? Because the damage and loss of life will be overwhelmingly among the poorest in the world - those who will have done least to cause the problem.)
It really doesn't seem like all that tough a choice.

It appears to me that the dissenters in this decision are basically saying that "the problem is so huge we should not hold our regulatory agencies accountable." What claptrap! The safest and sanest course is to reduce emissions and behave as though we have some responsibility to the world and future generations. Throwing millions of tons of greenhouse gases into the atmosphere as we are now doing is stupid. The technology to change this exists and if we apply it will actually benefit business in the long run. The people who espouse the dissenting view are in the service of big business and take a very short view. We should not let them determine our future; those so-called conservatives are not our friends.

No, the dissenters (preferrably called defiers) claim that humans haven't caused climate change, so trying to reverse it or its effects is pointless. Lets adapt to the change just the way our ancestors have done for countless generations.
Polluting the planet is stupid. Lets clean it up. Carbon dioxide is not a pollutant, so don't bother with that.
If you condemn all the means by which carbon dioxide has been pumped into the atmosphere, then you are essentially claiming that every advance realized by the industrial and technology revolutions has been a mistake.
I don't buy that.

It ain't black and white. Too much water in the wrong place is a pollutant, too much oxygen in the wrong place is dangerous and explosive. Too much carbon dioxide is not good for the temperature of the planet. We may not be the sole source but that doesn't mean we have to keep pumping large amounts and contributing to problem. No one is claiming that EVERY advance realized by the the tech/industry revolution is a MISTAKE! Framing it that way is absurd. Refusing to put your mouth over the tail pipe of a truck doesn't mean you think truck exhaust is good for you! Of course humans CAN affect the environment. Of course there are other forces too. Just because sewers and drains get clogged with leaves and overflow in heavy rains is not an argument for not having sewers and drains! This is not a Left/Right partisan issue. The Corporations/Business world wants you to think so as a distraction. Lets all smarten up, eh!

I find it interesting that while greenhouse gases have been increasing during all of the 20th Century, the average Earth temperature and the average temperature in the US both went down from 1930 to 1970. As a matter of fact, I am old enough to remember many scientists in the late 60s expressing deep concern about the coming "ice age". There is much evidence to indicate that ocean levels aren't rising SIGNIFICANTLY and ALL glaciers are not shrinking. Is the globe getting warmer? Absolutely. Is it caused by man? Despite what "everyone who has half a brain" says, the evidence is contradictory and certainly not "beyond dispute". We got rid of freon and a lot of other ozone depleting chemicals, and the ozone hole over the Antarctic is still getting bigger. I think nature is a lot more complicated and "self healing" than we give it credit for. Let's stop the hysteria and look at the complete picture. Not lies, not cherry picking of "evidence", but all the facts. Rather than a bunch of "Chicken Littles" running around (or actually flying around spewing bounteous amounts of evil carbon into the atmosphere) screaming the sky is falling, let's tone down the rhetoric and look at ALL the facts. We can only be successful if our solutions take everything into account. If we go running off half-cocked only taking into account the evidence that supports our particular pet theory, what we end up doing may actually make the situation worse. And by the way, I do drive a Prius.

I drive a Ford F-250 Diesel. I NEED it for my work. While I would love to drive a "hybrid", I haven't the money...and YES to you greenies I do drive it to the Q.T. to get milk and a paper when I want it. Most of us do what we do out of necessity, not out of desire alone. Now the S.C. has "legislated" (haha) that the EPA HAS to regulate automobile CO2 emissions! Last time I looked plant life NEEDS CO2 in order to have photosynthesis inorder to expel O2 which we breathe. Possibly this is the S COURTS and the Leftists way of population control and slowing down the growth of an over heating economy. Sound ridiculous?? No more so than the opinion of the COURT. I'm convinced more than ever this country is screwed unless we have a serious voter/taxpayer revolution and get rid of these DC "panty wastes"!

I don't have a copy of the Clean Air Act, maybe I should get one. But you can't expect that the progress we have all enjoyed over the last 200 years and the resulting emissions from industrial and utility plants' smoke stacks, railroad engines, airplanes, ships, automobiles, and modern homes etc., comes without a price. Otherwise, we wouldn't have a Clean Air Act, would we?
It seems to me that the reason (Congress' intent if you will) for having an Environmental Protection Agency can be found in their name: That would be TO PROTECT THE ENVIRONMENT.
I read through the Court's decision and a couple of things bothered me. It seems the arguments the EPA makes boil down to "Its not our job, its the DOTs", "What good would it do anyway? - What with China and India" and "Its just too big of a job"
I am disappointed in their interpretation that CO2 is not a pollutant. Anything deviating from its normal concentration is capable of making something "unclean or impure". ANYTHING coming out of a vehicle's tail pipe should be subject to regulation. Haven't they been regulating tail pipe emissions before? If not, what have they been doing regarding vehicle exhaust? Scalia's dissent on the defintion of air pollution is ridiculous. I haven't seen any frisbees flying out of any tailpipes lately.

Any hope that one might have had that Supreme Court decisions are decided on the basis of anything other than personal political philosophy has been dashed by the dissenting opinion in this ruling. In a screed that has more italics than a freshman term paper, the Chief Justice argues that even if CO2 emissions in the U.S. contribute to global warming, they make up only 20% of world-wide emissions, so reducing them will not redress Massachusetts' grievance enough to establish legal standing. Using that logic, let's build all of our power plants on the eastern shore and let unregulated emissions blow across the Atlantic. And as to Congress' intent in the matter, well, it would appear that there's something to be said for judicial activism, after all.

I'm old enough to remember environmentalists spewing about the "ice age". I remember being scarred to death as little kid. Guess what? It never happened! Listen to the news sometime and count how many times the words " this months numbers were lower or higher than the EXPERTS had predicted". How many times does science get things wrong? Lots, lots, lots and lots more. I'm all for conserving, but don't indoctrinate me any more about something that is PURE speculation. Especially when the speculation comes from scientists.
