actually, kate, the argument is that keith urban the painter is trying to deceive people into believing that he's keith urban the singer and getting them to buy paintings. if so, that's illegal (copyright/trademark, etc, issues), and there are scores of examples where courts will not allow that.

I have not much idea who either Keith Urban is. I took a look at the website, and the types of Normal Rockwell styled paintings Keith Urban is selling are not going to appeal to people who like Keith Urban. Plus Keith Urban is older than Keith Urban, so he was literally there first.

Does anyone remember when Spike Lee tried to sue Spike TV? As if trademark laws meant he solely owned all uses of the word "spike". This is why we need loser pays rules in the civil courts. So many plaintiffs are losers.

The Keith Urban lawsuit is ridiculous. I checked the site and he in no way alludes that he is the singer Keith Urban. Not only should the loser (singer) pay in this instance, but I believe damages should also be paid for the inconvenience. He's just trying to bully the guy into giving up his domain name just because he has the money to bring up the lawsuit.

While yeah, it's kind of silly, the fact is his name is part of his marketing brand. The owner of KeithUrban.com is not saying he is the country singer Keith Urban, but he is also not pointing out he is NOT the country singer.

And honestly, I'm surprised this guy doesn't mention make mention of this. I'm sure he enjoys the traffic driven to his site.

Mr. Nicole Kidman or may not win here - the owner of the domain IS named Keith Urban, so it's not like he bought it with the intention of making a profit on selling it back. But Keith Urban has been recording since the early 90's, and KeithUrban.com was registered only 4 months before KeithUrban.net was registered in 1999.

I would think the guy would just take a payoff and change his domain to KeithUrbanArt.com - maybe that's what will happen here. It's not like this appears to be his livelihood, and he hasn't posted any paintings dated later than the mid-90's, which says he's not updating the site that frequently.

Besides, he's got Google Ads on the home page that advertise Keith Urban music and tickets - that could be a little confusing for an unsavvy web surfer. It will be interesting to watch, from a copyright standpoint (at least for me, who is part of the Internet community and good friends with an intellectual property lawyer ;) ).

As for Brooke and Fergie - according to IMDB, there's a 6 inch difference between them. If Brooke is wearing stilettos and Fergie was not, that 6 inch difference would become more obvious...

He has no control over that. Google ads choose the ads based on words that it finds on the page that the ad resides. Obviously painter Keith Urban has his name on his site, and google happens to have ads that get displayed when those words appear.

If that is the basis for Singer Keith Urban's lawsuit, he will surely lose.

I saw Fergie at LAX a couple of years ago and was surprised to see how tiny she is. I would guess she's shorter than me and I'm 5ft.4. I didn't go up to her and the Black Eyed Peas, but I saw that she graciously signed an autograph or two. I thought that was sweet at the time.

As for the Google Ads: you know that the site owner has no control over them. I know the site owner has no control over them.
