D.C. Judge Wants $65 Million for Lost Pants

It began innocently enough. A dry cleaner losing a pair of pants, an enraged customer seeking justice... just like that episode of Seinfeld. We've all been there, we've all wanted revenge, but what can we do? What indeed. Unfortunately for the Chungs, owners of Custom Cleaners in Northeast Washington, this pair of misplaced pants belonged to Judge Roy L. Pearson Jr., who unleashed an avalanche of legal absurdity so perverse Kafka would blush.

The administrative judge -- whose job, mind you, entails determining civil infractions and penalties -- claimed that he deserves $65,462,500 in damages for the "mental suffering, inconvenience and discomfort" caused by the loss of his suit pants. To put that figure in some perspective, at his current salary, it would take Judge Pearson just under 650 years to earn that kind of cash.

Despite his seemingly ridiculous claim, because of Washington's bizarre consumer protection laws, Pearson has been able to stretch his trouser-tort out for a couple years now, costing the Chungs many sleepless nights and thousands of dollars in legal fees. Their plight has been so vexing that they even offered him $12,000 to settle, and for the record his suit including the jacket, which wasn't lost, had a value of only $1,100. But still he refused. Now broke and "disenchanted," the Chungs are considering moving back to Seoul, their American dream throttled by American litigation.

Now if there was any justice, a person like Pearson would be disbarred for his actions, but as irony would have it a "panel of four D.C. officials" is currently assessing whether he will be reappointed to another 10-year term. That means Pearson could actually spend another decade on the bench, handing down decisions and determining justice. Talk about the fox guarding the hen house. The only thing crazier than keeping him on the bench would be appointing oil executives to run the Environmental Protection Agency... oh wait.

Pearson is the product of a spoiled, have-anything-I-want childhood. He needs to get over himself and let this go. It's just a pair of pants! There are so many other injustices in this world to be outraged over and fight for other than a stupid pair of pants. It's not like it's the only pair he has either. Remember that what goes around, comes around; and he'll get this same treatment in return, plus some. He's already given himself a bad name and probably has ruined his career because of his narcissistic attitude.

It is a shame that in our society even judges will dishonor their positions. Society looks up to judges as moral barometers and no one expects to see the system and immigrants abused and bullied by one. I sincerely hope that this judge is disapplined in some form for his disgraceful, childish and entitled behavior.

Emil, How can we all find out the names of the four judges considering this guy's reappointment? I think some input from the public into this decision is in order. It would be a travesty to have this guy sit behind a gavel for another 10 years!

This guy is an a-hole. We should also note that his obstreperous actions raise the cost of dry cleaning for everyone in the DC area.

Worse, he's an idiot. He's a judge, but he shows a clear misunderstanding of basic contract law (no emotional distress except in extraordinary circumstances; no punitive damages; no unforeseeable reliance under Hadley v. Baxendale). Of course he might be trying to sue in tort, but this is a clear contract case and the case should be thrown back into the contract arena by the pure pecuniary loss rule

It's abuse and childish on the judges behalf. The Chungs made a mistake of misplacing his pants. BIG DEAL!! They made an honest mistake and suing for that amount is CRAZY!! I think you're missing the point. That must have been a really nice pair of pants. You know, the kind that you could search for a lifetime and never find again.
Take a step back from all the legality and walk a mile in this man's shoes, except try to walk that mile without your favorite pair of slacks. If you take some time out and think about it, it's absolutely heartbreaking.

To make matters worse, he got screwed by a bunch of immigrants. There's no justice for situations like this. Everyone loses. Except the sweat shop workers who make the pants, probably somewhere in Korea. Because now they get to make one more pair of pants.

On Gene Weingarten's chat update one poster refers to the "a##hole tax", the penalty we all pay for the sins of a few, examples being self flush toilets, hot air hand dryers, etc. "Judge" Pearson [he is an administrative law judge, not a real judge, so I am sure he insists on being called "Judge"] is a more heinous example. Too fat to fit in his suit pants, too solipsistic to accept that things happen, too ego centric to comprehend the damage he does to public confidence in the system, he will create a counter movement that will work to the disadvantage of people with legitimate complaints.

OMIGOD! Another ratification of my addage, "Republicans Own The Best Judges Money Can Buy". I'm willing to bet he left the receipt ,from Pamela Martin Associates, in the pants and needs it for his negotiations for his book and movie. I say go ahead with discovery, bring the 'judge' in for a deposition and see if he really has suffered $65M worth of damages or only $6.50 that he paid for his britches. The Chungs should sue Pearson for public stupidity on a national scale. I'll be watching for his name on "20/20".

I would suggest this judges' actions are driven by something more than a simple desire to prove a point. His refusal to accept a settlement well beyond any just compensation demonstrates an attempt to destroy someone's livelihood using the burden of litigation.
I'm curious what his record on the bench looks like in cases involving persons of asian descent.

This guy is an american helping destroy the country that I have been raised in, fought for and support. Actions like this should be considered similar to terrorism, of course without the killing. If the justice system works he will be removed from position immediately, counter sued for damages and thrown in joe arpaios tent city in arizona (where you have none of the luxuries of prison) for a long time. Then when he gets out take his citizenship away, send him to korea and let the justice begin.

What is sad is that he is finding joy in the complete destruction of someone's life for an inconvenience that means nothing.

He is proof that some people are just bad people. They are just mean-spirited at heart and get joy from being cruel. I pity him more than anything. He's not even a man.

However, GOD IS JUST. He WILL be judged for this in the court that really matters and he'll lose that case for sure.

As an American I am ashamed and embarassed that these hard working people came over, paid taxes and attempted to live the American Dream only to be railroaded by an anti-social jerk in a position of power. As someone who's been screwed over by Custom Cleaners too let me say there service sux. I'm glad they're going out of business. $65 mil is a lot of money but the sign said "Satisfaction Garaunteed" and Pearson wasn't satisfied. They needed to their fraud right and they failed. Now they have to pay for it. I'm sick of people doing a half assed job. Cleaners will be a lot more careful from now on you can bet.

Step one: The judge's claim must be denied and sanctions imposed on him. The rules of court provide for sanctions to be imposed on those who bring BS lawsuits. The amount of the santion ought be the same amount the people being sued had to pay for legal fees. Step two: The judge's job cannot be renewed. Step three: Serious disciple ought to be imposed by the the bar; maybe a suspension but not disbarment, that's too harsh.

TO TOM: According to the article he asked to be compensated for the suit and they refused. It was only after he brought them to court that they tried to settle. He was reasonable first and they thought he would buckle. He didn't and now they are crying about it. I got no sympathy for sham artists like them. Let them go back to Korea, no skin off my back.

A judge needs to know the law well, and have good friends in powerful positions. That's about all it takes. The guy could be an a**hole but hey, this is what happens when our society is results-driven. Ethics are out the door these days. What matters is if you can deliver solid results. This happens in every sector, not just law.

As Americans it our right to sue. No other country in the world allows it to level we have. Maybe the judge went to far, but he didn't break any law or violate any oath. I find it absolutely appalling that this man should continue to practice law and certainly hope that there is some justice in the fact that he be quickly revoked of any "power" he may have. To the gentlemen to who have this man's career in their hands, to keep him in power is to do an extreme diservice to your profession. That he feels he has been wronged is one thing. And to be upset is understandable. But to be reasonable is also understandable, and expected. Any sane person in their right mind would take 12 grand for a pair of pants! What a sad day when a judge in this country is doing this kind of thing. We put people in jail for running scams and taking advantage of people...in this situation we have him as a judge. I would be first to say that the Chung's should replace the pair of pants, shake hands and go on their way but to throw out a number of $65 million dollars is absolutly ridiculous. I have also read thru Pearson's divorce paperwork and my best wishes go out to his ex-wife, I hope that she is now able to get on with her life. I hope that the Chung's are able to get thru this with the help of people like us that have a heart or have lost a pair of pants at the cleaners at one point or another in our lives and have moved on! What a pathetic excuse of a human being!!

Surprised no one has gone to the potential racial angle here. Pearson is African American and before being a judge, worked for a legal aid society. Certainly the kind of fellow who should side with the little guy. But maybe there is some resentment over Korean immigrants "moving in and doing better?"

If I worked hard for years and finally managed to become a small business owner, then judge Pearson did this to me, I'd be pushed over the edge and attempt to take away his life. They are just dry cleaning business people. They aren't multinational corporations executives. Pearson represents how flawed America's judicial system is.

Of interest is his persistent claim that he be awarded spousal support and his then wife's claim that he did not meet conditions of reconcilliation such as channging his "... controlling behavior, and becoming financially responsible."

Honestly I first was outraged when I read this but after digging further and finding out they lost two of his pants it made me remember the time I had a bad experience with a Dry cleaners. They washed 5, expensive & only worn once shirts of mine in a laundry machine and shrunk them all. I was so pissed. But never was I racially motivated or even upset enough to bring them to court. Still what happened was wrong. So I must admit that to some degree it makes me happy to see all the other dry cleaning services forced to take notice that some of us are willing to take the time out to hold them accountable for their actions But 65 Million Is too much. The only fair thing that can be done at this point IMO is that the judge not get another dime and the dry cleaners be reimbursed for legal fees.

Of course the judge is a shill for the Republicans seeking tort reform. This much is obvious. The real truth is, however, that many people really do deserve large payments, and we should not bow to Bush et al., who want to put caps on how much a person can be compensated for wrongful injury. That capping is good for the rich, and bad for the poor, as the Republican lemma goes. Please people, use your common sense and see through this very transparent ploy. That judge is not worried about losing his position, he is smoking cigars right now in the backroom with his conservative/Republican buddies, who will reward him handsomely. Clearly, this judge needs to be removed from his position and disbarred. Then he should be put into a burlap sack; along with a rabid monkey, a couple of cobras and three cats; that gets sewn shut and tossed into the ocean. I strongly believe that Judge Pearson has a case here, as long as people in the U.S. can feel free to interpret laws (e.g., the Washington customer protection law) AND signs literally.

After all, the Chungs were quite willing to clean Judge Pearson's pants because they were quite satisfied with the judge's service request, as this agreement is so protected by the sign "satisfaction guaranteed" that was posted in the store; otherwise, the Chungs wouldn't have accepted the service request if they didn't feel satisfied with Judge Pearson's request for dry cleaning his pair of pants.

Also, to my understanding, the Chungs did the service on the same day the service was requested; thus, they did not violate any agreement implicated by the sign "same day service" whatsoever. I seriously do not believe that Judge Pearson knew the difference between "same Day service" and "same day DELIVERY".

This is what I would add to the biography:

Judge Pearson filed a $65 million lawsuit against a defenseless hardworking Korean couple who ran a mom-and-pop dry cleaner for losing his $1000 pants. The $1000 pants were found a day or two after Judge Pearson originally complained to the Korean dry cleaners. However, Judge Pearson unfairly refused to take back his pants. Judge Pearson lost all credibility because of his actions and helped to perpetuate the racial tension between Asians and Blacks in the predominately black Washington D.C. urban area. Judge Pearson no longer wears pants, or at least no longer wears the $1000 pants that were found and that he refused to reclaim and therefore wasted $1000 by no longer having the pants. C'mon folks, of course the judge is not serious -- the $15,000 every weekend to rent a car is a dead giveaway -- it is a joke. Of course the judge is a shill for the Republicans seeking tort reform. This much is obvious. The real truth is, however, that many people really do deserve large payments, and we should not bow to Bush et al., who want to put caps on how much a person can be compensated for wrongful injury. That capping is good for the rich, and bad for the poor, as the Republican lemma goes. Please people, use your common sense and see through this very transparent ploy. That judge is not worried about losing his position, he is smoking cigars right now in the backroom with his conservative/Republican buddies, who will reward him handsomely. This sort of low-level strategy reminds me of the *agitators* in LA -- who wants to bet me that they were Minutemen, wearing those bandana/masks. And the investigation will show that members of the police force were also in on it -- the strategy of the agitators using video cameras and then the police herding them back into the park to then start their melee is right out of the Mein Kampf playbook. Nothing is below these Republican/conservatives, and the tragedy is that you liberals are all too naive to even spot these things, so they continue to take advantage of you like a smart mouse with some dumb mice.

Having read all the previous postings here, I will mark my comments.
1. In regards to the suggestion put forth by "R.OBrien", you should be arrested and jailed for cruelty to animals, or perhaps you should be put in the bag with the judge.
2. In regards to the comments from "johnnormansp", I will take it from them that you have returned to using recreational drugs again. This is not a matter of party affiliation but a matter of common sense, something that 99% of the members of the legal profession lack.
3. I would suggest to "ALL PERSONS HAVING BUSSINESS" in the court of Judge Roy Pearson that they request an immediate reassignment to a different judge do to the clearly biased and prejudicial attitude of this judge and he obvious lack of common sense with which to interpret the law.

In this day and age when the United States simply cannot afford to make any more enemies, this imbecile is not helping our cause, not internationally, and certainly not for the people of DC.

Is this guy actually a stealth proponent of massive tort reform? First, enrage every single person with any sense of common decency, even if you destroy the livelihood and dignity of an entirely innocent, hard-working family in the process.

Then, more people will be in favor of radical tort reform where businesses that have behaved in a stunningly negligent manner will be held even less accountable than they are, Ford Pinto style.

The solution is obvious.

After Judge Pearson's suit loses the court could award the Chungs all the lost earnings and lawyer fees and some pay and suffering causing Pearson to owe a substantial amount.

Pearson's case should not be equated with that of a person who has actually been harmed by corporate negligence.

This is about one wacko in a case that probably should have been dismissed early on and there is no proof that he will be reappointed.

I am surprised at someone at the Post following this manufactured gambit on such a non issue by the right wing noise machine.

Others have suggested that this judge be removed from the bench. I was hesitant to suggest that in my previous posting as I never want to see a person lose their means of making a living. However during the day today I saw an ad on TV that "shouted" at me, "here is where this person would be right at home working". He would still be in the legal fie
