Louisiana Mayor Bans Sagging Pants
Delcambre To Punish Low-Rider Fashion With Jail Time
It seems like all I've been blogging about this week is pants, but this story -- like the $54 million pants suit -- is too strange to ignore. Still, I promise next week to drop my pants blogging entirely!
That said, the droopy drawers détente has marched westward from Florida to Louisiana into the "Cajun-country town" of Delcambre. That's where Mayor Carol Broussard announced his plans to sign an ordinance making it illegal for folks "to let the waistband of [their] pants sag too low in public."
The new law would carry strict penalties for violators, including fines up to $500 and jail terms of up to six months if underwear or private areas are visible. That second stipulation effectively closes the "commando" loophole left open by Florida's measure, which focused only on visible undergarments. Also, unlike Florida's failed attempt to ban plunging waistlines, this ordinance has teeth and the support of local politicians. Moreover, it avoids attributing the fashion to "gangs" and a "hip-hop lifestyle," focusing instead on the public indecency aspect, which from a legal standpoint gives it a leg up.
Still, as with any sartorial law, there are questions of free expression, privacy and liberty. And then there is simple common sense: Prohibitions on a style, whether legal or not, are the surest way to make said style cool. It's like slapping a parental advisory label on a CD. Just ask NWA what that did for their sales.

While I do find the low slung pants disgusting besides being totally impractical, the question does arise that does this also apply to the women's low rider's with the thong and rear end exposed at every squat? Where will the line be drawn? Are mini skirts and plunging tops going to be out next.

So what exactly is the operational definition of pants that are "too low"?
This looks like a simple stupid law, but it is in effect much more. It without a definition of "too low" it gives the police power to arrest anyone who wears pants.
Our founding fathers would likely punch Carol Broussard square in the face for being such a tool.

If this gains momentum, why stop there? How about say, $300 and 2 months in jail for mismatched socks, and 30 days for wearing your hat sideways. $75 and 45 days should dissuade those who think they can end a sentence with a preposition. Why? Because I don't like it. Would this be any more stifling and ridiculous than the bill at hand?

This is ridiculous! I suppose we need a law now that regulates how we tie our shoes. We wouldn't want to create a tripping hazard! Maybe there should be one that regulates the number of buttons on a shirt a man is aloud to leave open. Another law could fine women for not wearing a bra under their shirt. I really think they should incorporate one for how far a man's belly can "sag" over his belt. I mean, that's just gross!
This is obviously targeting a certain group in our society. Apparently, the lawmakers in Delcambre have nothing better to do then to set regulations on the local dress code.
By the way, what constitutes "saggy"? I suppose it has to be more than an inch from the hipbone. Do they have to hire and train the Saggy Bottom Police? I wonder how much that will cost...

I don't know what all the fuss is about. The first time someone is cited for having low-pants, the law will die. I doubt the people in this backwater town are dumb enough to let this get past a low-level state appeals court.
Don't worry about the Mayor of Delcambre reading any of the comments here. I seriously doubt they even have electricity in that town. Maybe he'll hear someone talking about it on his way to the outhouse.

It does sound like they are basically trying to marginalize and criminalize black culture under the guise of public decency. I like the references above to miniskirts, thongs, and plumber's crack. How can you draw the line in a law like this? By having it only apply to a certain way of wearing your pants that is popular among hip hop artists and their fans.

Believe me, I don't like to look at them - but I'm sure when I go out wearing my sweats and hair tied back looking a mess, people don't like to look at me much either! I like what the cop said, let them wear them baggy so that they can't run!!! Webster, the issue isn't public nudity. That's a traditional no no, and nobody is tryin to say lets all run around naked. The problem here is a new fashion fad comes up and some people don't like it and decide to re-draw the decency line. But who gets to redraw it, and along what guidelines? The line here, drawn by a small group of legislators, is drawn so obviously along racial / cultural lines it's sickening. Bathing suits leave less to the imagination than sagging pants, why not ban them too? I bet these legislators don't mind looking at people in bathing suits. Their "public decency" justification is a sad facade.
Think about it. If you wear boxers as shorts, no problem, you are just wearing shorts. If you happen to put jeans over them and sag them just enough to look like a gangsta, in Louisiana you can go to jail. F'ing ridiculous.

This is in response to the gentleman who suggested that Delcambre not worry about this and "move the dead bodies" and "fix the dams". First of all you should look at a map because Delcambre is about 140 miles from New Orleans and there are no dams. Second, if you are going to call these people "MORONS" you may want to do a spell check on your note. A second grade teacher would have failed you on your grammar and spelling.

If someones private parts are showing, bust them, but as long as they're covered, why does it matter what is covering them? This is a clear violation of freedom of expression, and I hope someone stands up for freedom and challenges this law in court.

First of all, Delcambre is a small town with a very small population of African Americans (25 total in high school according to the State Board of Education in Louisiana) so contrary to popular belief, this is not a racial law.
Secondly, I am a teacher in a large town. I see kids of every race wearing the sagging pants. These kids are not your "A" and "B" students...they are the under-achievers, gang thugs etc. Just like schools have banned students from displaying gang symbols at school, they have also banned this type of clothing at most schools.
Thirdly, while Delcambre was devastated by a tidal surge caused by Hurricane Rita, no lives were lost and no dams were involved.
Last of all, is this a blow to our freedom of speech? One needs to realize that our freedoms are not all inclusive. There are some important obligations that go with our freedoms. The sagging pants is a symbol of unlawful gang activity and that alone shows a disregard for the obligations one owes to their society.

About the new law in the city of Delacambre: there is a way to fight such a law. I'm sure the mayor or the members of the city council have children or grandchildren. If they fear for the life of their children or grandchildren, they won't legislate such laws.
It is very simple: children and granchildren can be killed, and that will make their parents sad. Very sad!

I'm sure any of you that have lived in Louisiana are aware that this has very little to do with "decency". It is more in the realm of Southern Baptist tyranny. Utah has Mormons and Louisiana has Southern Baptists. Louisiana government has had for a long time now, a very dangerous level of "small town mentality". What you libs seem to be missing is that what is being addressed here is the constant and relentless expansion of acceptable moral boundaries. In the end you will ultimately demand public nudity be allowed.

One of JFK's own staff members admitted they used it as "a massive strategy to harrass" Republicans on the radio into giving up or having their shows cancelled by the stations who didn't want the massive headaches. It worked then, and you want to do it again. You can't compete in the arena of ideas, so you try to shut down the arena itself. Don't try that freedom BS with us. We know you better than that.
The truth of the matter is that the only people who you want freedom for is YOURSELVES. The only people you are looking out for are YOURSELVES. You want outlaw any opposing ideas. You can't even mount an intelligent counter-argument. Someone makes an argument in opposition to your positions on ANY issue - you call them names, insult them, assassinate their character, ANYTHING.
Why? Because you know your ideas and positions when examined on their merits will be proven faulty.

I feel that this ban is unconstitutional and an invasion of privacy. If we start telling our people what they can and cannot wear, then we are just as bad as Iraq and Bahgdad. I think this is where, as a leader, Bush needs to step in and proove that he has or sons and daughters, sisters and brothers fighting for the rights of people and not oil, payback or any thing else.
