The $54 Million Pants Suit Takes Another Bizarre Turn
The latest victim in the $54 million pants lawsuit is Custom Cleaners itself. According to the Chung's lawyer, Christopher C.S. Manning: they have closed Custom Cleaners dry cleaners due to the revenue losses and emotional toll resulting from the Pearson v. Chung lawsuit. The business has been sold. Having had to close two of their three dry cleaning stores since the initiation of the lawsuit, the Chung family is currently focused only on their Happy Cleaners store located at 1119 7th Street, NW in Washington, D.C. The Chungs hope that a successful Happy Cleaners store will help them someday rebuild their businesses in the aftermath of the lawsuit.
The immigrant family, who arrived from the charcoal pits of Korea in 1992, now must be wondering if it was worth it? "This is a truly tragic example of how devastating frivolous litigation can be to the American people and to small businesses," writes Manning. "This family had poured its heart and soul into their dry cleaning stores only to have their dreams crushed by Roy Pearson's lawsuit." Like most of the world, the Chungs are struggling to fathom why Roy Pearson continues to pursue his case. Regardless of the outcome, the damage is already done. So far they have lost much of what they have toiled for, and with another year to 18 months until this is resolved there is no telling what else they'll have to sacrifice in their defense against the DC Judge who keeps on suing.

I'm so sick of hearing Roy Pearson referred to as a judge. He is a fraud who got his position thanks to affirmative action. Nobody likes or respects him. In a few months he'll be an even greater drain on the district when he becomes a welfare recipient.

What is everybodys problem. Don't judges have the right to sue? Seems unfair to hold them to differing standards doesn't it. Whats worse is the racism that I've been reading against him though. Affirmative action has nothing to do with this case and is destructive to talk about that way.

JPG might not be a moron, but even if Pearson was not a judge, his baseless lawsuit should be illegal bacause it ruined the Chungs. He should have never been allowed to sue - judge or not.
I think they should force Pearson and other idiots like him to post a bond to cover court and legal costs of the other party in case he loses. Then you will see stupid lawsuits like this disappear.

The solution here is not to b- and moan about Pearson but instead get to work on changing the DC tort laws. Only through that can we actually prevent such frivolous lawsuits from happening again.

I agree, JPG is a moron. The Chungs came to this country to better their lives and contribute to our "melting pot". Pearson is a money grubbing pig who thought he could get rich off of a lawsuit. The Chungs are a part of what makes America the greatest country in the world. Pearson just makes me ashamed there are Americans like him.

You all are willing to trade our American right to litigation because you think the judge is greedy. Well you people obviously don't understand the Law one iota. Pearson isn't suing to recoup the money but rather to fight for the DC consumer. He plans on redistributing the winnings throughout the community. He is a gentleman and community leader.

In the first place, without the act, he could never have chance to get into law school.
In the second place, without the act, there was no way for him to be appointed as a judge.
In the third place, without the act, there is no way for him to still hold the judgeship.

All I can say is that Judge Pearson is a judge in name only. We should not get into the race issue because that just clouds everyone judgement.
I am Asian, but I don't care if he is black, white, Hispanic or Asian, this is such a ridiculous law suit. I would like to ask all of you to ask yourself one question "Do you think a pair of pants are worth two dry cleaning stores and the years of hard work to build up your business?" Plus, the Chungs offered to settle for approximately $10,000. Is there a pair of man's suit pants worth $10,000?

Please this is such a waste of taxpayer's money. Of course he has the "right" to sue, but that doesn't mean it was the "right" thing to do. How about common sense, how about treating others as you want to be treated. This lawsuit was a slap in the face for everyone who has ever had to use the judicial system. His race has nothing to do with this anyone who did this would be wrong.

Sunny: You are right. But this "right" to sue is not wriiten in stone. In essense, scum like Pearson is himself a lawyer, who doesn't have to pay high legal fees. Second, the man apparently doesn't have a penny to his name. What has he got to lose? If he sues any business at random, some would settle just to cut costs.
That's why tort reform is a must. We should all work towatd tort reform. For example, in Canada, the loser always pays for the other party's legal fees. And silly lawsuits like this are very rare there.

I'm saadened by the loss of the Chungs business and wish they had the strength to fight Pearson assuming he had something to win. Obviously this lawsuit has been a waster and a travesty to our judicial system.
The next question, given his past actions at the courthouse (sleeping with his sons girlfriend who he hired in the courthouse, video taped smoking crack in the courthouse among likely more that the public doesn't know yet),
WHY ON EARTH IS HIS STILL PUBLICLY EMPLOYED MAKING A 6-FIGURE INCOME!
Probably because DC govt is riddled with people just like him, there is no other reason, right?

Pearson is NOT fighting for the consumer. He thinks that a "Satisfaction Guaranteed" sign is false advertising, but Judge Bartnoff said, "A reasonable consumer would not interpret 'Satisfaction Guaranteed' to mean that a merchant is required to satisfy a customer's unreasonable demands or to accede to demands that the merchant has reasonable grounds to dispute." Some customers are irrational and they will never be satisfied. People certainly have the right to take action when they have a bad experience with customer service. They can complain to the manager of the establishment or take their business elsewhere or go to small claims court or the Better Business Bureau if they have been defrauded. But filing a multi-million dollar lawsuit over a pair of pants is ridiculous.

Pearson reminds me of Captain Ahab. Just instead of insanely sailing the oceans in search of a white whale, he's fixated on punishing a poor family of drycleaners who happened to misplace the wrong pants from the wrong idiot. For the Chungs, it's definitely a sad commentary, but for Pearson, it's hard to say. Ahab killed his whale, and didn't seem to care so much that it ruined him and all of his friends. Pearson will never be respected again, yet for that he will gain immortality, and that's what he's really after--the last word at any cost. Pearson will be mentioned in psychology textbooks a hundred years from now as well as business and law books. That's not even mentioning the "believe it on not" lists that will bounce around emails for as long as we have email. I know nothing about Pearson, but I'm positive he sees nothing inappropriate with his actions and feels no remorse.

Let me tell you what's really pathetic. This is not the first time that Pearson claimed the Chungs had lost his pants. He has a bad memory. And they found the ticket along with his pants. This important phyical evidence means that the Chungs did not likely do ANYTHING wrong at all! He must have brought in the wrong pair of pants.
Now the Chungs suffer big loses because of Pearson's own ERROR!!! So his "Satisfaction Gurantee" argument doesn't even apply here.
How tragic.

Sure Pearson has the right to sue... Damages for the maximimum amount of having his pants replaced.
The anguish bit is totally stupid. Someone in the position of judge should know better. I think the Chungs should sue Pearson for ruining their business and cousing them anguish.
See how Pearson likes that... And I would bet they stand a better chance...
Pearson is the one causing damage here.. not only to the Chung, but to the US judicial system...
