Selling Sex Toys Now Legal In Texas
5th Circuit Picks Privacy Over Morality
Feeling lonely in the Lone Star State this Valentine's Day? You'll be glad to know that the 5th Circuit Court of Appeals has just overturned a statute outlawing sex toy sales in Texas.
According to a law on the books since the 1970s, the sale, promotion, donation or lending of "obscene devices" was punishable by up to two years in jail. And all it took to "promote" was a goodie drawer of six or more.
The statute was seldom enforced. But the owners of two Austin sex shops, as well as a retail distributor doing business as Adam & Eve, claimed it hindered their business and deprived potential customers. The state argued that it had a moral basis for maintaining the law, "discouraging prurient interests in autonomous sex and the pursuit of sexual gratification unrelated to procreation."
The 5th Circuit, however, found that sexual privacy supersedes that morality. The court cited Lawrence v. Texas, the 2003 U.S. Supreme Court decision that struck down bans on consensual sex between same-sex couples. The 5th Circuit, siding 2-1, said it is unconstitutional to punish individuals selling sexual devices, since those devices are typically used in the privacy of people's homes.
Alabama and Mississippi now remain the only states where sales of sex toys is illegal, though several other states have restrictions. The defenders of those laws say it would be dangerous to make sex toys more easily accessible. They note that sexual addiction is a recognized mental disorder, and they worry that sex toys may encourage that.
So has Texas opened up a Pandora's box here? Or has the Lone Star State simply opened its mind?

If the government is supposed to protect people you cannot separate how they do it from morality. Fundamentally all of our laws have a basis in morals. God gave us guidance in the bible. His words speak to us through the ages.

Personally I feel that any attempt of a government entity to regulate the personal lives of its subjects is wrong. If you are not harming another citizen, have at it. There is also a law which states that you cannot drive cattle through town on a Sunday if I am not mistaken. You want to know why it is still law?...because it doesn't matter enough to spend the time and money which would be required to vote on it. Who really cares if the law is not enforced? This article states it pretty clearly that it wasn't enforced. On a personal note, I wasn't aware that it wasn't legal. Someone needs to tell this to my local adult video store. This law was passed when the Texas was run by Democrats,with LBJ as its Senator. Most of the conservative Texas Republicans I know are concerned with issues other than what toys their nieghbor has in their bedside drawer.

It is insane what our lawmakers and keepers spend their time debating and making decisions on.

I am a native Texan and think this law was that should of gone away a long time ago. If it is not enforced in the first place why have it on the books, mayby vengence, abuse of power, or just plain meanness. When laws are no longer enforced or needed for whatever reason, should be removed from the books so they can not be miss used. This law was used a few years ago in Burluson by a vendictive person and the victim got screwed because of an outdated peice of legilation.

There are a number of things to pick apart here. First, it's excellent to see an arbitrary and decidedly silly law overturned - using a vibrator or dildo for the occasional release doesn't hurt anyone at all. In fact, it's safer than real sex, for someone not in a committed relationship!
I know very few people, male or female, who would state that a sex toy is a good long term "replacement" for a real relationship. Additionally, people against the use of sex toys or "marital aids" would do well to remember that such toys can go far to help a couple keep their sex life fresh.
As for Matt, who appears to be from Texas? - Well, Matt, thankfully you're incorrect. States do NOT have the right to regulate their population in everything they do. States are governed by the US constitution, which includes the Bill of Rights. Additionally they are governed by state constitutions. State governments cannot arbitrarily decide what is "best" for their populations when what is "best" is superseded by the US constitution. On a less level-headed note, I doubt quite sincerely that you would be so vehement about a state's right to "regulate all matters" if the Texas legislature suddenly (received a lobotomy and) decided to outlaw guns, or write into law the right for a woman to have an abortion.

There's no good reason to prohibit the selling of sex toys; it doesn't hurt anything. Buying sex toys should be easier than buying guns in my opinion.

The Replublicans, which often have plenty of their own sex scandals going on "Lots of fruits have fallen from the Replublican Tree." How does the existance of sex toys cause another person to lose sleep at night? Besides, look at all the "champions of morality" out there, they're usually into some pretty freaky stuff themselves (Bill O' Reilly being one example). The first being the state being able to interfere with how people live, as we in Engalnd now call ours the Nanny state i.e. more and more they are advising/telling us what we can eat, how much to drink, whether we can smoke, combined with much political correctness etc. The second point is much the same Should local government be aloud to pass unneccessary victorian repressive statutes. As many feel it's ridiculous to outlaw sex toy sales (evidenced by the majority of U.S. States having no similar law or restriction), and as many agree that Texan laws are horribly flawed, this is a step in the right direction. Way to go Texas! Enjoy your new-found liberation. Maybe there's hope for the United States after all...
And another point - sexual freedom and expression is a "REAL" issue, affecting all people of all genders and backgrounds. The sex industry generates a multi-billion dollar revenue for its proprietors, and the last time I checked, corporate capitalism is no miniscule topic here in the good ol' US of A. Are nudy bars outlawed in Texas? Dirty video stores? What's the difference between a device and a visual?
The point is - the Texas law was inappropriate and contradictory to the ideal of Texan morality (as evidenced through the sale of other sex-industry related outlets) and antiquated to boot. Hail to the Texan court for squashing another "morality" law.

Does the overturning of a law that was already circumvented by calling sex toys different names really all that big a deal to Social conservatives? Are you really concerned that it is going to make Texas an immoral place to live? I always thought Texans always prided themselves on being rebels anyways, not conservatives who stick to the status quo. I mean look at Willy Nelson and "Outlaw Country" music. That is what being Texan is all about.
Now if the court overturned the law and made it a requirement that every person in Texas had to own at least 6 sex toys, I would agree with the outrage. Allowing people their freedom is not unamerican wether it be to own or sell sex toys or practice their religion. In fact it is the most patriotic thing you can do. Don't infringe on my freedom because you find it immoral.

Why is everyone so surprised about this. The government wants a say in every thing you do. And don't be naive and say it's a republican or democrat issue. It's a government issue. The more laws they make, the better chance you have of breaking one. Then they get to punish you by taking away money or freedom. Either way is ok because it allows you to do less. That is what government is for nowadays. Punishing, fining, and charging fees. This used to be such a great country and now it sucks. That's right it sucks. And it's not the nation, flag or the people. It's the governments. Particularly, the federal government. The people who go to work for the federal government change. They stop being normal citizens and start being rulers. And as rulers, whether for the federal government or the state governments, all they know how to do is limit what you do. It is not in the nature of governments or the people that work for it to enable. People do that for themselves.

I think its absolutely hilarious people are criticizing an outdated law they only knew about because of news of it being taken off the books. I don't know "whats next?" applies since Texas obviously rescinded the sex toy ban, probably for reasons discussed in this thread?

while I myself am not one to use "sex toys", I dont believe it's wrong. It's not the government place to say what is moraly right, thats a matter of oppinion, and since birds tend to fly with a flock of the same feather I imagine that the people making morality laws generally have a similar oppinion about what is the right or wrong way to do something. Furthermore, sex toys are not going to promote, encourage, or worsen any sort of sexual addiction thats a mental dissorder with or without the "Toys"

It is true that of all that goes on in the adult stores, is considered to many, a "none of your business" issue..........but it is hard for it to be said when you knwow all of what CAN happen just by walking in the store. I use to work in one of those, and believe it or not, when you ring up a customer, it is hard to not think of what he/she will or might do. whether its a video that they are renting or a 8' cyberskin dong. From the many options that the customer has, he/she decided to get that one particular item......hmm.....I wonder why. When you pick your strawberries, its because the customer thinks and wants to believe they are the sweetest from all. Well same thing applies for all merchandise that is for sale. Customer buys a dong for satisfaction. whether its for him or her. Or for that other 33% that get EVEN if they didnt ask for it.....that is why the customer didn't only bought the 8' cyberskin dong, but he/she also bought the handcuffs, the gag ball, and left the store with his/her shamefull head looking down and out the door...............It is hard to not even think of what the customer will end up doing. An adult store is just a cover up for the "must need" in the list of another "AMERICAS MOST WANTED"

Yes the law was rediculous! I love my toys and I love Texas! Yes, we have our issues, but please do not imply that ALL Texans are crazy, backwards, idiotic people.
